Terms of Service

These Terms cover the Listen in Deep app, the Academy, and the collaborative tools we use alongside that work. They're written to be read — if anything here is unclear, email us and we'll explain it properly.

One-to-one psychotherapy and coaching with Gareth are not covered by these Terms. That work has its own separate client agreement, and Section 6 explains why.

01Introduction

These Terms of Service ("Terms") govern your use of the services offered by Listen in Deep. That includes:

  • the Listen in Deep app at app.listenindeep.com, on both the free and Plus tiers;
  • the Listen in Deep Academy ("the Academy") — our membership, course and community platform; and
  • any collaborative tools, such as a shared Trello board or template, used alongside your work with us.

Gareth's separate one-to-one psychotherapy and coaching sessions are not covered by these Terms. They're governed by their own client agreement, as explained in Section 6.

By creating an account, purchasing a course, joining the Academy, or otherwise using any of the above, you agree to these Terms. Our Privacy Policy explains what information we collect and how we handle it, and forms part of your agreement with us alongside these Terms.

You'll notice the Privacy Policy covers more ground than these Terms — it includes Gareth's one-to-one therapy and coaching, which these Terms don't. That's deliberate. These Terms are the contract for the app, the Academy and our collaborative tools, and one-to-one work has its own contract. The Privacy Policy isn't a contract: it's the explanation, required by data protection law, of everything Gareth does with personal information across the whole practice. Rather than make you find two of those, there's one, and it covers everything.

02Who we are

Listen in Deep is operated by Gareth Willett, a sole trader trading as "Listen in Deep".

Gareth Willett is an accredited member of the British Association for Behavioural and Cognitive Psychotherapies (BABCP), membership number 160104. That accreditation governs his separate one-to-one psychotherapy practice (Section 6). It does not govern the app, the Academy or the community, which are not clinical services.

In these Terms, "we", "us" and "our" mean Gareth Willett trading as Listen in Deep, including anyone working on our behalf; "you" means the person using our services. Our Privacy Policy is written in the first person, because it comes from Gareth directly — "I" there and "we" here mean the same person.

03Accepting these Terms

You accept these Terms when you:

  • create an app account, whether by email, Google or Apple sign-in;
  • purchase a course, or join the Academy membership or community; or
  • accept access to a shared Trello board or template we provide alongside your work with us, outside one-to-one sessions.

When you create an account you'll be asked to confirm that you're 18 or over and that you agree to these Terms and our Privacy Policy. We keep a record of the date you confirmed and which version of each document you were shown.

If you're booking a one-to-one therapy or coaching session, acceptance works differently — that's governed by Gareth's separate client agreement, not these Terms. If you don't agree with these Terms, please don't use the relevant service.

04Eligibility

You must be at least 18 years old to use any Listen in Deep service — the app, the Academy, or any collaborative tools we use alongside your work with us. This matches Section 17 of our Privacy Policy.

We ask you to confirm this when you create an account. We don't otherwise verify age, and we rely on what you tell us. If we find out that someone under 18 has an account, we'll close it and delete the associated data.

05What we offer

The Listen in Deep app is a self-guided self-discovery app. It's a set of tools for reflecting on your own life, in your own time, at your own pace — a structured 90-day self-discovery framework, a journal holding your Reflections and your Dream Journal, breathwork and meditation tools, and the Inner Guide, a feature that lets you talk things through with an AI companion. The Inner Guide is one part of the app, not a separate product or service, and Section 17 sets out what it can and can't do.

What the app gives you is structure, prompts and a private place to think. What you make of it is yours — the work is self-directed, and we don't promise any particular outcome from it (Section 20).

The Listen in Deep Academy — "the Academy" once you're in it — is our membership platform: online courses, an ongoing membership, and a community space for peer connection and support.

None of this is therapy, counselling, medical advice or a crisis service, and nothing in any Listen in Deep service should be treated as a substitute for professional support. Section 17 sets out the app's limitations in detail, and it's worth reading properly rather than skimming.

06Gareth's separate clinical practice

Gareth Willett, who created Listen in Deep, is a BABCP-accredited CBT psychotherapist. He offers one-to-one psychotherapy and coaching separately, outside these Terms.

Using the app, the Academy or the community, including the Inner Guide, does not create a therapist-client, coaching or any other professional relationship with Gareth Willett personally, and isn't governed by BABCP's clinical standards. Those apply to his separate one-to-one practice, under its own client agreement, not to the services covered here.

If you're a one-to-one client and also use a shared Trello board with Gareth as part of that work, the confidentiality and access terms of your client agreement apply to that board — not the general Trello clause in Section 15, which covers Trello use outside one-to-one work.

07Your account

You're responsible for keeping your account credentials secure — for the app, the Academy, or both — and for anything that happens under your account. Please use accurate information when signing up, and let us know if you believe your account has been accessed without your permission.

Changing your details. You can update your name in Settings at any time. To change the email address on your account, email us and we'll do it — your address is linked to several records behind the scenes, including your billing and, if you use cloud storage, your encrypted backup, so changing it in one place isn't enough. Please keep it current: it's how we reach you about your account, about changes to these Terms, and about anything going wrong with a payment.

Your app content — journal entries, conversations with the Inner Guide, insights, embodiments, your Story So Far, practice records and progress — is stored locally on your own device, not on our servers, unless you're on Plus and have chosen to turn on cloud storage (Section 8). Academy account and participation data — course progress, community posts, membership status — is stored on our membership platform. The Privacy Policy sets out the full detail for each service.

If you stay local-only: what that means for you

Choosing not to use cloud storage keeps your content entirely under your own control, but it also means the responsibility for keeping it safe sits with you, not us. If you lose your device, clear your browser data, or uninstall the app without having exported a backup first, that content can't be recovered — not by you, and not by us, because we never had a copy to restore from. This isn't a risk we can mitigate on your behalf; it's the direct trade-off of us never holding your data.

To protect against this, you can export a full backup of your app content to a file at any time from Settings, and re-import it on a new device or after reinstalling. We'd recommend doing this before switching devices, and periodically if your content matters to you.

08The app: Free and Plus

The app offers a free tier with the full core experience — the 90-day framework, the journal, the breathwork and meditation tools, and the Inner Guide — and an optional paid tier, Plus. Plus currently unlocks a more capable Inner Guide, a choice of voices — the free tier uses your device's own voice, and Plus adds two others — the Journey Card, and the option of cloud storage described below.

The Journey Card is a keepsake image summarising your 90 days, built from your own progress, insights and Inner Guide sessions over that period, which you can download or share. It's assembled entirely on your device — none of the content behind it is sent anywhere to make it.

We may add, change or retire individual Plus features over time. We'll always aim to keep the free tier genuinely useful on its own.

Fair use

Use of the Inner Guide is subject to a fair-use limit of 80 messages per hour, per device. It's there to protect the service from misuse and keep it affordable to run, and it's set well above what reflective use looks like — if you're having a long conversation, you won't reach it. If you ever do, it resets within the hour, and the app will tell you rather than simply failing.

How long things are kept on your device

Your journal entries — Reflections and Dream Journal alike — are kept until you delete them. Nothing clears them automatically. The same goes for your insights, your embodiments, your Story So Far, your breathwork and meditation records, and anything you write at the end of a journey.

Your conversations with the Inner Guide are cleared from your device after 120 days. This is the one thing the app removes without being asked, and it applies on both Free and Plus. If you want to keep a conversation beyond that, export a backup from Settings before it ages out.

One small trace outlasts it: a note of when a conversation happened, with nothing of what was said, so your history and counts stay accurate afterwards.

Local storage, and the Plus option to keep a copy in the cloud

By default, and always on the free tier, your app content — journal entries, conversations with the Inner Guide, insights, embodiments, intentions, your Story So Far and progress — is stored locally on your own device only, as described in Section 7. You're never required to change that.

If you're on Plus, you can additionally choose to turn on cloud storage, so an encrypted copy is also kept on our servers — useful if you switch devices, reinstall the app, or want a backup. This is an explicit, separate choice from subscribing to Plus itself: turning it on isn't automatic, and turning it off again at any time is just as easy.

Your content is encrypted on your own device, with a Secret Key that only you hold, before anything is sent. We can't read it. The Privacy Policy explains how this works, what happens if you lose your Secret Key, and what isn't encrypted — please read Section 6 there before turning it on.

Cloud storage is a backup, not an archive. It mirrors what's currently on your device rather than keeping a separate long-term store, so it doesn't keep anything for longer than your device does. When your Inner Guide conversations clear at 120 days, the next sync removes them from the cloud copy too. Cloud storage protects you against losing what you have — it doesn't extend how long it's kept.

If you cancel Plus, cloud storage keeps working as normal until your Plus access ends at the end of the billing period you've already paid for (Section 11). From that point — or from the day you press "Turn off" in Settings, if you switch cloud storage off without cancelling Plus — we keep your cloud copy for a further 30 days, in case your subscription lapses by accident or you change your mind, then delete it.

If you'd rather it were gone straight away, Settings also has a "Delete everything now" button. That turns cloud storage off and deletes the cloud copy in the same action, immediately, with no 30-day wait.

09The Listen in Deep Academy

The Listen in Deep Academy — the Academy, from here on — is our membership platform, bringing together online courses, an ongoing membership, and a community space for peer connection and support.

Courses

Purchasing a course gives you a personal, non-transferable licence to access and use that course's materials for your own learning, on the terms in Section 14.

Free and Academy Plus

The Academy has a free tier and a paid tier, Academy Plus. Academy Plus is billed monthly or annually, on the recurring basis described in Sections 10 and 11. Cancelling stops future renewals; you keep Academy Plus until the end of the period you've already paid for, and your account then reverts to the free tier rather than closing.

Community

The community is a space for peer conversation and mutual support. It is not professionally moderated or supervised in the way a therapy or coaching session is, and conversations there aren't confidential the way clinical work is. Other members are not clinicians, and nothing said there is professional advice.

Please treat other members with respect. We may remove content or restrict access for anyone who breaches Section 16.

10Billing and payment

Plus and Academy Plus are billed monthly or annually, in advance. Individual courses are typically a one-off purchase. How your payment is handled depends on where you subscribe:

  • Through the website or the app in a browser: via our payment processor, Stripe. We don't store or see your card details — Stripe handles payment processing directly.
  • Through the Apple App Store or Google Play Store, once a native app version exists: via Apple's In-App Purchase or Google Play Billing. Those purchases are billed, and any refund requested, through Apple or Google directly under their own terms — see Section 11.

Beyond that:

  • Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
  • Prices are shown in GBP and include VAT where it applies.
  • If a renewal payment fails, we may retry it and suspend access to the relevant paid service until payment succeeds. We'll tell you before we suspend anything.

11Cancelling, refunds and your right to change your mind

11.1 Cancelling a subscription

You can cancel Plus or Academy Plus at any time from your account settings — no email, no phone call, no retention conversation. Cancelling stops future renewals. You keep access until the end of the billing period you've already paid for, after which your account reverts to the free tier of whichever service you cancelled.

11.2 Your 14-day right to change your mind

Because you buy from us online, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days from the day you buy to change your mind and cancel, without giving a reason. Here's how that works for each thing we sell.

Plus and Academy Plus. When you subscribe, you're asking us to give you access straight away. If you change your mind and cancel within 14 days, we'll refund what you paid in full. The law would let us keep a proportionate amount for the days you had access. We don't.

Courses. You have the same 14 days to change your mind about a course. If you cancel within that window, we'll refund you in full. We'd rather you had a course you actually wanted than a refund you had to argue for.

To cancel under this section, just tell us clearly — email [email protected] saying you want to cancel, or use the form at 11.7. You don't have to use the form. We'll refund you within 14 days of receiving your cancellation, to the payment method you used.

11.3 After the 14 days

Once the 14-day window has passed, we don't refund the unused part of a billing period you've already paid for. You can cancel at any time and keep access until that period ends.

11.4 Annual renewals you didn't mean to make

We'll email you before an annual subscription renews, so it shouldn't come as a surprise. If one renews anyway and you haven't used the service since, tell us within 14 days of the renewal date and we'll refund it. We'd rather do that than take a year's payment for something you're not using.

11.5 If something's faulty or isn't as described

Separately from any of the above, the Consumer Rights Act 2015 gives you the right to a repair or replacement if what we've supplied isn't of satisfactory quality, fit for purpose, or as described — and to a price reduction if that doesn't put it right. Section 20 covers this. Nothing in this section affects those rights.

11.6 If you bought through the Apple App Store or Google Play

Cancel and request any refund through Apple or Google directly, not through us. Those purchases are governed by their terms and refund policies, which we don't control and can't override.

11.7 Cancellation form

You don't have to use this. Cancelling in your account settings or sending us a clear email does the job just as well, and both are faster — we'd much rather hear from you that way than by post. But you're entitled to the form, so here it is.

12Changes to price or plans

We may change pricing, or what a plan or membership includes, from time to time. If a price change affects your subscription, we'll give you at least 30 days' notice by email before it applies to your next renewal, and you're free to cancel beforehand if you don't want to continue at the new price.

13Your content

13.1 It stays yours. Anything you write, record or upload remains yours — your journal entries, your conversations with the Inner Guide, your insights and embodiments, and anything you post or share in the Academy. We don't claim ownership of any of it, and we never will.

13.2 App content. Your app content lives on your device, not on our servers, unless you're on Plus and have turned on cloud storage (Section 8). So in the ordinary case we don't have access to it at all. The Privacy Policy sets out the specific exceptions — principally that messages you send to the Inner Guide, and the data used to generate your Story So Far and Story Card, pass through Anthropic to produce them.

13.3 The permission we need to run the community. When you post in the Academy community or submit work as part of a course, you give us permission to store, display and distribute it inside that space, for as long as it's posted and for a short period afterwards while it sits in our backups. That permission exists for one reason — so we can show your post to the other members — and it doesn't go any further. It does not let us use what you wrote in marketing, on our website, in a course, or anywhere outside the Academy. If we ever want to quote something you've written, we'll ask you, and you're free to say no.

13.4 Other members' content. What other members post belongs to them. Please don't copy it out of the community or repeat it elsewhere. And be clear that the community isn't confidential in the way clinical work is — Section 9 explains this.

13.5 Removing content. You can delete your own posts at any time. We may remove content that breaches Section 16, and we'll tell you why where it's reasonable to do so.

14What belongs to us

Everything we make and supply belongs to us or to the people who license it to us. That includes the app and its code, the Academy and its courses, our written, audio and video materials, our templates, and our frameworks and their names — including the 5-Step Self-Discovery Framework — together with the name "Listen in Deep" and our logo.

While your account or course access lasts, we give you a personal, non-exclusive, non-transferable, revocable licence to use all of that for your own personal, non-commercial development. That licence is the whole of what you may do with it.

So, to be specific — you may not:

  • copy, resell, sublicense, publish, upload or share our materials, in whole or in part;
  • use our frameworks or materials to teach, coach, train, supervise or deliver a service to anyone else, whether paid or unpaid;
  • use them to build a competing product or service — including by using them as training data, context or source material for an AI model, assistant or agent;
  • remove or obscure any notice of ownership.

If you'd like to use something of ours in a way this section doesn't allow — in your own practice, for instance — ask. We're often glad to say yes, on terms.

If you send us feedback, an idea or a suggestion, we can use it freely and without owing you anything. We won't name you as its source without asking you first.

15Trello and other collaborative tools

Some Academy or course work involves collaborative tools like Trello — for example, a template you turn into your own board, or a board you invite us to view or edit alongside you.

  • A template we hand over becomes yours to adapt and keep. We don't retain any ongoing claim over your customised version, though the underlying template remains ours under Section 14.
  • Where you grant us access to your own board, that access is limited to what you've shared, and you can revoke it at any time.
  • We treat content on a shared board with the same confidentiality we apply to other material you share with us.
  • Trello is a third-party service, governed by its own terms — see Section 18.

If the collaboration happens within one-to-one therapy or coaching, Section 6 and your client agreement govern it instead of this section.

16Acceptable use

Please don't use any Listen in Deep service to:

  • attempt to disrupt, overload or reverse-engineer the service;
  • scrape, resell or redistribute the service or its content without permission;
  • impersonate someone else or misuse another person's account;
  • harass, abuse or intimidate other members, in the community or elsewhere;
  • share another member's words or personal circumstances outside the community;
  • use the service for anything unlawful, or to generate content intended to harm yourself or others.

We may suspend or terminate accounts, or remove content, that breaches this section.

One thing worth being clear about, because it cuts both ways. Almost nothing you do in the app is visible to us — your journal and your conversations with the Inner Guide stay on your device, or are encrypted with a key only you hold (Section 17). So we can't monitor for breaches of this section, and we don't. Where something is visible to us — a community post, for instance — we can act on it, and we will. And where the law requires us to preserve or hand over information we actually hold, we'll comply; our Privacy Policy explains when that can happen.

17The Inner Guide — the app's AI companion, and its limits

17.1 What it is

The Inner Guide is a feature inside the Listen in Deep app — one part of it, alongside your journal and the breathwork and meditation tools. It isn't a separate product, a separate service, or something you subscribe to on its own.

It is software. It generates its replies automatically, using a large language model provided by Anthropic. It is not a person, a therapist, a counsellor, a doctor, or any other regulated professional, and using it doesn't create a professional relationship of any kind with anyone (Section 6).

Your Story So Far and Story Card are also generated using Anthropic's models, from your recent insights and embodiments — not written by a person, and not reviewed by one before you see them. Everything in this section about what the Inner Guide can and can't do applies equally to them.

17.2 What it can't do

  • It can't diagnose, assess or treat anything, and nothing it says is medical advice.
  • It has no clinical training, no professional accountability, no supervision, and no duty of care to you.
  • It only knows what you've written into the app. It can lose track of context, misread tone, forget what you told it earlier, and state something confidently that's simply wrong.
  • It can't tell how you're actually doing. It responds to words on a screen. It can't see you, hear distress in your voice, notice that you've gone quiet for three weeks, or judge how serious something is.

17.3 No one is reading this

This is the most important thing on this page, so it gets its own clause.

Your conversations with the Inner Guide are not read, reviewed or monitored by Gareth Willett or by anyone else — not at the time, not afterwards. On the free tier, and on Plus without cloud storage, they never reach us at all; they stay on your device. With cloud storage on, they're encrypted with a key only you hold, so we couldn't read them even if we wanted to. There is no person on the other side of the app. Nobody will see what you write and check that you're alright. If you tell the Inner Guide that you're in danger, no alert is raised and no one is notified.

We're saying this plainly because the app is made by a psychotherapist and it might be reasonable to assume otherwise. Please don't.

17.4 What we've designed it to do about risk, and what we can't promise

We've designed the Inner Guide to stay away from deep trauma work and crisis work, and to point you toward human support when something serious comes up. That's how it's intended to behave, and we test it against that intention.

But it's automated software, and we can't and don't promise that it will recognise a crisis, respond appropriately, or respond at all. It may miss what matters. Please don't rely on it to notice that you need help, and please don't use it as a way of telling someone that you're struggling. Tell a person.

17.5 If you're struggling right now

  • 999 — if you or someone else is in immediate danger.
  • NHS 111, option 2 — urgent mental health support, 24 hours a day, in England.
  • Samaritans, 116 123 — free, any time, day or night.
  • Shout — text 85258, free, if talking isn't possible.

17.6 Who this app isn't for

The app isn't designed for people in acute distress or crisis, or for people being actively treated for a severe mental health condition, and it isn't a substitute for that treatment. If that's you, please talk to your GP, your care team or your therapist before using it, and keep the support you already have. Reflective work of this kind can sit alongside clinical care very well — it just shouldn't replace it, and it shouldn't be the only thing holding you.

17.7 Use your own judgement

Treat anything the Inner Guide says the way you'd treat a thought that occurred to you in the shower: possibly useful, worth sitting with, not authoritative. Check anything that matters — particularly anything touching your health, your medication, your relationships, your money or a major life decision — with a person qualified to advise you on it.

18Third-party services

Parts of our services are provided by third parties — including our payment processor, hosting, membership platform, cloud storage, AI, voice, notification and collaboration providers (Trello, for instance). The Privacy Policy lists all of them by name, in Section 13.

Their own terms and privacy practices apply to the parts of the service they provide. We aren't responsible for the acts, omissions, unavailability or content of these third-party services.

Where you interact with one directly — for example, using your own Trello account to work on a shared board — your use of it is also governed by that provider's own terms, separately from these Terms.

19Availability and changes

We aim to keep our services available and working well, but we don't guarantee uninterrupted access — third-party outages, maintenance or unexpected issues can affect availability. We may update, add to or remove features over time.

20What we promise

When you buy from us as a consumer, the Consumer Rights Act 2015 gives you rights we can't take away and aren't trying to. In particular, what we supply must be of satisfactory quality, fit for the purpose we've described, and as described. If it isn't, you're entitled to have it put right, and to a price reduction if we can't. Nothing in these Terms affects that.

Beyond those rights, here's what we do promise: we'll provide our services with reasonable care and skill, we'll be honest about what they are, and we'll tell you when something changes.

And here's what we don't promise, so there's no ambiguity:

  • that the app, the Academy or the community will always be available or entirely free of faults — we rely on third-party services (Section 18) and sometimes they go down;
  • that anything the Inner Guide, your Story So Far or your Story Card generates will be accurate, complete, or right for you. Section 17 explains this properly, and it's important;
  • that using any of this will produce a particular result — an insight, a change, a way of feeling. This is self-directed work. What comes of it depends on you, and on circumstances neither of us controls. Anyone who promises you otherwise is selling something.

21Our responsibility to you

21.1 What we're always responsible for. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't permit us to limit. If any part of this section conflicts with that, that wins.

21.2 What we're responsible for. If we fail to meet these Terms, we're responsible for loss or damage you suffer that's a foreseeable result of that failure — meaning either it was obvious it would happen, or we both knew it might when you signed up.

21.3 What we're not responsible for. Subject to 21.1, we're not responsible for:

  • loss or damage that wasn't foreseeable;
  • app content you chose to keep only on your own device and then lost, in the circumstances described in Section 7. That's the direct trade-off of us never holding a copy, and we've been explicit about it;
  • a cloud copy you can no longer read because you've lost your Secret Key. We can't recover it — that's what makes the encryption meaningful — and your device copy is unaffected;
  • the acts, omissions, failures or unavailability of a third-party service we rely on (Section 18);
  • any decision you take on the basis of something the Inner Guide, your Story So Far or your Story Card generated (Section 17);
  • business losses. We supply these services for personal, non-commercial use. If you use them for a business purpose, we're not liable for lost profit, lost business, lost data or lost opportunity.

21.4 The most we're liable for. Subject to 21.1, our total liability to you for everything arising out of or in connection with these Terms is limited to the greater of £100 and the total amount you paid us in the 12 months before the event that caused the loss. The cap in this clause does not apply to anything in 21.1.

22Ending your account

Deleting your app account. You can delete your app account from Settings at any time. That permanently removes your app content from the device you're using — it can't be undone, so export a backup first if you might want it. If you've used the app on more than one device, you'll need to do this on each of them: we have no way to reach content we've never held.

If you had cloud storage on. Deleting your account also deletes your cloud copy and the account record we hold, within 30 days — or immediately, if you use "Delete everything now" in Settings first. The Privacy Policy sets out exactly what that covers, including how backups are handled.

One thing we keep. We hold on to the record that you agreed to these Terms — your email address, the date, and which version you accepted — for six years after your account closes. It's the only thing that survives deletion, it's kept because it's our proof the agreement existed, and data protection law expressly allows it to be retained for that purpose. It contains nothing you wrote in the app — no journal entries, no conversations, none of your content.

Leaving the Academy. You can cancel Academy Plus from your account settings, and you keep it until the end of the period you've paid for. You can also close your Academy account yourself, free tier included, from your account settings.

Your community posts stay where they are when you go — they're part of conversations other members took part in. You can delete your own posts at any time, and doing that before you close your account is much the quickest way to be sure they're gone. If you'd rather we dealt with it afterwards, email us and we will, though for a long membership it may take us a little time.

If we end your account. We may suspend or end an account that breaches these Terms, and we'll give you notice and a reason where it's reasonably possible. Your data is deleted on the same terms as above. Where we've ended an account for a serious or repeated breach, you're not entitled to a refund of the unused part of a period, except where the law says otherwise.

23Complaints

If something's gone wrong, tell us. Email [email protected] with what happened and what you'd like us to do about it. We'll acknowledge within five working days and aim to resolve it within 30 days.

We don't currently subscribe to an alternative dispute resolution (ADR) scheme. If we can't resolve your complaint between us, you're free to take it to the courts of England and Wales (Section 25).

If your complaint is about how we've handled your personal information, you can also complain to the Information Commissioner's Office at ico.org.uk or on 0303 123 1113 — though we'd appreciate the chance to put it right first.

If your complaint concerns Gareth's separate one-to-one psychotherapy practice rather than the services covered by these Terms, please raise it with him directly first — email [email protected] and he'll respond personally. You're also free to take it to the BABCP at babcp.com at any point, whether or not you've come to him first, and doing so won't affect anything else.

Complaining doesn't affect your access to anything. Not to the app, not to the Academy, not to the community. If we've got something wrong, we'd rather know.

24General

If part of these Terms doesn't hold. If a court decides that any part of these Terms can't be enforced, the rest still applies.

If we don't insist on something. If we don't enforce a term straight away, or at all, that doesn't mean we've given up the right to enforce it later.

Things outside our control. We're not responsible for failing to provide a service where that's caused by something genuinely outside our control — a provider outage, a network failure, illness, fire, flood, industrial action, or an act of government. If it looks like lasting more than 30 days, either of us can end the affected subscription and we'll refund the part you've paid for and won't now receive.

Nobody else can enforce these Terms. This contract is between you and us. Nobody else has rights under it, under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

Transferring this agreement. You can't transfer your account or your rights under these Terms to someone else without our written agreement. We may transfer our rights and obligations to another business — for example if Listen in Deep is incorporated as a limited company, or the business is sold. If we do, we'll tell you in advance, your rights won't be reduced, and you can cancel within 30 days and be refunded for any period you've paid for and won't now use.

Which document wins. If these Terms and the Privacy Policy disagree about how personal information is handled, the Privacy Policy applies. If these Terms and a separate one-to-one client agreement disagree about one-to-one work, that agreement applies. In everything else, these Terms apply.

How we'll contact you. We'll use the email address on your account, so please keep it current. Notices we send take effect the day after we send them.

25Governing law

These Terms are governed by the law of England and Wales, and any disputes will be handled by the courts of England and Wales — without prejudice to any mandatory consumer protections you're entitled to in your own country of residence.

26Changes to these Terms

We may need to change these Terms from time to time, but only for one of these reasons: a change in the law or in what a regulator requires; a change in how a service works or what a plan includes; a change to how we handle payments, security or a third-party provider we depend on; or to correct a mistake or make something clearer.

For minor changes — clarifications, corrections, a new provider that doesn't affect what you get — we'll update the version number and effective date at the top of this page.

For changes that affect your rights — price, what a plan includes, cancellation, or our liability — we'll email you at least 30 days before they take effect. If you don't want to accept them, you can cancel before they take effect, and we'll refund any part of a period you've paid for but won't now use.

Changes never apply retrospectively: whatever version was in force when something happened is the version that governs it. Previous versions are available on request.
